  1. 1. The main terms – summary

    This is a summary of the main terms which apply to Vodafone 360 services.

    1. Not all Vodafone 360 services will work with all mobile equipment and not all services are available to customers who are not connected to the Vodafone network.
    2. All content (apart from apps) will be provided by your local Vodafone operating company or partner company, under separate terms and conditions.
    3. You must be 14 or over to register for the Vodafone 360 services. You must be registered to use all of the Vodafone 360 services.
    4. Keep your username and password safe. You are responsible for all activity on your account.
    5. Vodafone 360 services are for personal (and not business use) only.
    6. Please make sure that any content (such as photos, updating your status) you upload to any of the Vodafone 360 services keeps to the law and our community guidelines.
    7. We may monitor any content you post or remove it if we feel it breaks our terms or may cause complaints.
    8. We are not responsible for any content provided by another person or organisation which you can have access to using the Vodafone 360 services.
    9. When accessing Vodafone 360 services on your phone or computer, you will be responsible for the data charges your mobile operator or internet service provider may charge.
    10. We will let you know about any extra costs which apply to any Vodafone 360 services before you buy them.

  2. 2. Description of Vodafone 360 services

    The Vodafone 360 services include People, Email, Photos, My Web and Shop. Below we describe them all in full, and explain who is providing them.

    People brings together all your contacts from your mobile and from email, chat and social network accounts. It also gives you easy ways to manage your contacts on your PC, and keep them up to date and in line with those on your mobile. You will be able to bring together any of the social networking accounts listed on www.vodafone360.com using People.
    Email is an email service that brings together your email accounts and gives you easy ways to send, receive and manage emails. You will be able to bring together any of the email accounts listed on www.vodafone360.com using Email.
    Photos backs up all of the photos you have taken on your mobile (if your mobile is compatible with this service) and gives you easy ways to share photos from your mobile or your personal 360 website.
    Shop allows you to browse and download content, including games and applications.
    My Web gives you your own home page which you can personalise and use on both your mobile and your computer. Any changes you make on your computer will automatically be shown on your mobile.

    All services are provided by Vodafone Sales and Services Limited unless we say otherwise.

    We may add new Vodafone 360 services, which will also be covered by these terms and conditions.

  3. 3. Details about the service

    Vodafone 360 services are provided by Vodafone Sales and Services Limited ('Vodafone') registered in England and Wales at Vodafone House, The Connection, Newbury, Berkshire RG14 2FN under registered number 06844137 and registered VAT number GB 569 95 32 77. We also deal with complaints relating to copyright owned in the United States – you should send any claims to Vodafone.

    You can see the latest version of the terms at this link and we recommend that you print and keep a copy. You can agree to these terms in any of the following languages – English, French, German, Italian, Spanish, Greek, Portuguese, Danish, Dutch, Turkish, Czech and other languages that we make terms available in from time to time.

    You will have to keep to the version that is presented to you in your own language. If we make any changes to these terms, we'll make sure that we will give you 30 days' notice by publishing any changes on this page.

  4. 4. Your account and your information

    When you provide personal information, please make sure it only relates to you and that it is correct. Remember that you are responsible for any activity on your account. Please also read our privacy notice which sets out in detail how we use your information.

  5. 5. Using Vodafone 360 services

    We are giving you a non-exclusive right to:

    • download and use the software (if it is needed) to display Vodafone 360 services on your mobile equipment; and
    • display and use compatible Vodafone 360 services on your mobile equipment and computer.

    In both cases shown above this must be for your own personal use only. At no time must you make any profit from using the services.

    We may allow you to upload, store, view or share contacts, messages, photos and other content on People. How much you can store will be limited and we may decide on reasonable limits from time to time. You should always back up any content that you want to keep. You are responsible for any content that you add, upload, store or share, so make sure that it keeps to all laws which may apply and the community guidelines. In particular, you must make sure that it is not harmful or offensive in any way.

    By adding a social network or other account to the People service and including your friends' contact information from that account, you may be restricted from transferring contact information relating to those friends to other people and other address books. This protects your friends' contact information and will continue to apply even if you delete your People profile.

    By accepting these terms you agree that we can:

    a) monitor how you use the Vodafone 360 services; and

    b) review the content that you share to make sure it keeps to these terms, and in particular, our community guidelines.

    We can remove any content that you add, upload, store or share at any time if:

    • we reasonably believe it breaks these terms;
    • we receive any complaints about the content; or
    • it may have a negative effect on the service, other users or us.
  6. 6. Starting and ending the Vodafone 360 services

    These terms apply to you from the date you first start to use any Vodafone 360 services to the date that you stop using Vodafone 360 services and delete your People profile, or the date we end the service.

    If you use Vodafone 360 services in any way that breaks these terms or which may have a negative effect on the service, other users or us, we may end your access to any or all Vodafone 360 services.

    We may suspend or change any or all Vodafone 360 services immediately and without giving notice for any reason, including if repair or maintenance work is needed.

    We may add new features from time to time and do not have to offer any particular features made available through Vodafone 360 services.

    We can permanently withdraw any or all of the Vodafone 360 services. However, we will give you at least 30 days' notice if we do so.

    If you have not used People for more than six months, we may end your account. (However, we will always give you notice first and give you a reasonable period for you to either continue using the service or save your information elsewhere.)

    You agree that any cancellation rights you have under the Consumer Protection (Distance Selling) Regulations 2000 or other laws which may apply in relation to any individual Vodafone 360 service will end as soon as we start to provide the Vodafone 360 services to you.

  7. 7. What we are not responsible for

    We provide the Vodafone 360 services on an 'as is' basis. Not all Vodafone 360 services will work with all mobile equipment – you will need to check that your mobile equipment is compatible with the Vodafone 360 service before you register. We will not be responsible for any loss or damage that we or you could not reasonably expect at the time you first registered to use Vodafone 360 services or which is out of our control. We will also not be responsible for:

    a) any loss or damage arising as a result of any content which you upload, store or share;
    b) any content or services provided by another person or organisation;
    c) any loss or damage that you could have avoided or reduced by being careful or taking reasonable steps; or
    d) any loss of, or corruption to your content or other data if that loss or corruption is not caused by us or is out of our reasonable control.

    We encourage you to read the terms and conditions and privacy policy of any website, application or service that you use, visit or from which you receive content.

  8. 8. Cost

    The price of items or services you buy from us using Vodafone 360 services will be the price advertised at the time you buy them or in any extra terms and conditions. The price will include VAT and any other tax which may apply. We or our chosen agent will collect any amounts due by adding the amount to your account if you are a monthly subscription customer or taking it from your balance if you are a prepay customer. If you have missed any payments you owe, we can stop providing any or all Vodafone 360 services.

    When accessing or using Vodafone 360 services from your mobile equipment or computer, you will be responsible for all of your access and data charges from your internet service provider or mobile operator. Applications you download or that are made available to you may automatically connect to the internet to update information or provide a service to you.

  9. 9. Legal rights

    Nothing in these terms will affect any legal rights you have as a consumer. For more information about your legal rights, contact an organization that can provide advice for consumers.

  10. 10. Our rights

    We and our licensors own all proprietary rights in Vodafone 360 services. You will not have any right to Vodafone 360 services apart from the right to use Vodafone 360 services in line with these terms.

  11. 11. General terms

    We may allow another person to carry out any of our obligations under these terms on our behalf. You agree that we may transfer our rights and responsibilities under these terms to another Vodafone company. If we transfer our rights and responsibilities to any other organisation, we will let you know. At any time we can reveal any information we consider necessary to satisfy any law, regulation, legal process or government request which may apply. If any of these terms (or part of them) cannot be enforced by any court or other authority, we will delete it from these terms and it will not affect the rest of the terms. We may send you notices by email, text, post or on our website. These terms and Vodafone 360 services will be governed by the laws of England and Wales. Any disputes will be dealt with by the courts of England and Wales.

  12. 12. Changes to terms and conditions

    This version of these terms will be in effect from 15th September 2010.

    We have improved and simplified the services available to you. However, some features will no longer be available, including:

    • connecting with other 360 users; and
    • only sharing between 360 users. Content you have shared with other 360 users will no longer be accessible from 15th September 2010 so you should back this up before that date. In the new version of 360 you will be able to share photos with all of your friends and not just 360 users.
